Licensing + Use Conditions

Disclaimer of warranty + Distribution permissions

Spectragryph (standard version) is provided as freeware for non-commercial, private, academic and educational use, this includes also non-profit organization (i.e. schools, universities, UN organizations, public authorities, police, fire brigade, hospitals). In this case, you will receive a free licence on request and you are granted the right to use and to make an unlimited number of copies of this software for your own use. While this license is generally valid forever, the non-commercial nature of use needs to be re-verified every two years. Commercial users will have to purchase a license for legal permanent use. A single licence is valid for either a single user on several computers or several persons on a single computer, but not for several persons on several computers. Once acquired, the license is valid forever and even includes all future updates to the software.

Spectragryph is provided "as-is" and without warranty of any kind, express, implied or otherwise, including without limitation, any warranty of merchantability or fitness for a particular purpose. In no event shall the author of this software be held liable for data loss, damages, loss of profits or any other kind of loss while using or misusing this software. The software must not be modified, you may not decompile, disassemble. The software is only available via the author's website, no one else is allowed to distribute it or sell it, except with the author's permission. Distribution licenses for the non-commercial version are available on request.

 

explanation of commercial use vs. non-commercial use

A commercial company is every business with the intent to make profit (now or in future). Every way of using the software inside a commercial company is considered as "commercial use", notwithstanding that it may not directly generate revenues. Permanent commercial use requires a one-time license purchase. Everything else is illegal, according to the use conditions accepted during installation of the software. Commercial use for a limited period of time is free, as it is not considered as permanent use.This limit is contained within in the software, depending on use volume. Non-commercial use is free forever without limitations.
